New Delhi: Supreme Court on Monday refused to grant urgent listing of a PIL seeking a CBI probe into the alleged fake encounter of Bharat Bhushan Tiwari (28) in Bihar's Bhojpur district.

Justice BV Nagarathna asked the petitioner to first approach the registrar for listing the case. "Mention before the registrar first," she told petitioner-cum-advocate Vishal Tiwari.

The plea alleges that fake encounters and police brutality in states such as Bihar and Uttar Pradesh pose a serious threat to the rule of law and democratic governance.


The plea contends that encounter killings represent a breakdown of the constitutional framework where police officials assume the role of judge, jury and executioner. It states that in a democracy, the power to punish lies exclusively with the judiciary and not with law enforcement agencies.
