The Supreme Court Thursday indicated that a mechanism needs to be evolved to ensure that investigation of cases involving the Enforcement Directorate (ED) and the officials of a state government can take place transparently.

A division bench of justices Surya Kant and K V Viswanathan verbally remarked that a pan India mechanism needs to be evolved, which ensures that offenders do not go scot-free while vindictive arrests and mala fide witch-hunting do not take place.

The development took place during the hearing of a petition filed by the ED, seeking transfer of a bribery case filed against its officer Ankit Tiwari by the Tamil Nadu Directorate of Vigilance and Anti-Corruption (TNDVAC). The ED wants the case transferred to the Central Bureau of Investigation (CBI).


Issuing notice on ED's plea, the bench directed TNDVAC to not proceed with the investigation against Tiwari in the meantime and asked it to share all material collected so far in the instant case. It also directed the Tamil Nadu government to file its response on ED's plea within two weeks.
