A bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana questioned the bona fides of the petitioner, Santosh Daundkar, while declining to set aside the NGT's September 16, 2025 order that had upheld the environmental clearance.
"They are living there. If in a residential house they want to have (additional floors) ... it's their choice. The law is broadly followed. Why should a neighbour or anybody else intervene?" the bench remarked.
Appearing for the petitioner, senior advocate Shoeb Alam argued that the matter should not be viewed differently merely because it involved a prominent film star. He submitted that Daundkar, who had previously exposed the Adarsh housing scam, is a respected activist.
The petition had challenged the Maharashtra Coastal Zone Management Authority's decision to grant CRZ clearance for the renovation and expansion of Khan's sea-facing residence in Mumbai's Bandra.
The NGT had dismissed the plea, holding that the petitioner had failed to establish any procedural irregularity or legal infirmity in the approval granted by the Maharashtra Coastal Zone Management Authority. The Supreme Court has now affirmed that position by refusing to interfere with the tribunal's ruling.
