Supreme Court notice to RS secretariat on Raghav Chadha’s plea challenging his indefinite suspension

The Supreme Court on Monday issued notice to the Rajya Sabha Secretariat on a plea filed by AAP MP Raghav Chadha, challenging his indefinite suspension from the Upper House. Chadha was suspended on August 11 for allegedly obstructing the House proceedings. Issuing notice, a bench headed by Chief Justice of India DY Chandrachud also asked the Attorney General R Venkataramani to assist the court in the matter.

Appearing on behalf of Chadha, senior advocate Rakesh Dwivedi questioned whether there : The Supreme Court on Monday issued notice to the Rajya Sabha Secretariat on a plea filed by AAP MP Raghav Chadha, challenging his indefinite suspension from the Upper House. Chadha was suspended on August 11 for allegedly obstructing the House proceedings.

Issuing notice, a bench headed by Chief Justice of India DY Chandrachud also asked the Attorney General R Venkataramani to assist the court in the matter. Appearing on behalf of Chadha, senior advocate Rakesh Dwivedi questioned whether there was any jurisdiction to suspend an MP pending an inquiry through a House resolution and an order of the Chairman.


The senior lawyer further asked whether such an order could be passed after the matter had been referred to a privileges’ committee based on the same grounds for examination, investigation and reporting.

He also underscored the significance of considering the doctrine of proportionality and the potential breach of the ethics committee provisions in the suspension order.
