Plea against linking of Aadhaar-Voter ID: SC asks petitioner to approach High Court

The SC observed that an "efficacious alternate remedy" was available before the high court.

Refusing to entertain a plea challenging the provisions of election laws allowing linking of voter IDs with Aadhaar numbers, the Supreme Court on Monday directed the petitioner to approach the Delhi High Court with his plea.

The SC observed that an "efficacious alternate remedy" was available before the high court.

A bench comprising Justices DY Chandrachud and AS Bopanna asked Congress leader Randeep Surjewala to first approach the Delhi High Court. The counsel for the petitioner contended that "three different states will soon go to election" and that there could be variance in the outcomes of the different high courts.


Responding to this contention, the bench verbally observed that in case there was multiplicity of proceedings, the Centre could move the SC for clubbing and transferring the petitions. It remarked that if required, the petitions could be clubbed and sent to one high court for adjudication.

Surjewala had petitioned the Supreme Court challenging the validity of Sections 4 and 5 of the Election Law Amendment Act, 2021 which allow linking of Aadhaar and voter IDs.
