Supreme Court will finally take up the plea related to the disqualification of 12 MLAs that were appointed as Parliamentary Secretaries in Manipur. The matter is listed for July 26.

The plea has been filed by D.D Thaisii. The plea alleged that the Election Commission of India has failed to discharge its constitutional duty.

Manipur High Court on 17 September 2020 strike down Manipur Parliamentary Secretary (Appointment, Salary and Allowances and Miscellaneous Provisions) Act, 2012, and the Manipur Parliamentary (Appointment, Salary and Allowances and Miscellaneous Provisions) Repealing Act, 2018.


Manipur Congress had moved Governor Najma Heptulla seeking disqualification of MLAs for it amounts to office of profit. The Governor has sought the view of the Election Commission.

The EC has opined since the Acts mentioned above were in force at the time they held the office, the MLAs could not be disqualified for holding office of profit retrospectively.

Ningombam Bupenda Meitei, Congress spokesperson in Manipur said, “Supreme Court of India will finally dispose of the matters related to the disqualification of 12 MLAs, who were appointed as Parliamentary Secretaries in Manipur, on 26th July of 2021.”
