Justice Sachin Shankar Magadum noted that the issue, arising from the ongoing war in the Persian Gulf, was best handled by the government. The government was doing its best and this was not a matter for judicial review, particularly in a war-like situation, the judge commented.
The court recorded the Centre’s assurance and acknowledged the government’s efforts to ensure equitable distribution of LPG cylinders across sectors. It further underscored that courts should refrain from issuing directions in matters involving sensitive policy decisions in times of global conflicts.
The Court also took note of a recent decision by the Bombay High Court, refusing to intervene in issues linked to LPG supply disruptions. The court’s observations came on a petition from the Bangalore Hotels Association and its members, who flagged concerns over LPG shortages affecting their business.
Solicitor General Tushar Mehta, appearing for the union government, submitted that the situation remained fluid and was influenced by factors beyond the government’s control. He also added that the union government had been in touch with the States and was coordinating supplies.
