Election roll exclusion doesn't lead to deportation: ECI to Supreme Court

The counsel for the poll body argued that ECI is legally empowered to refer such a case to the central government for scrutiny and take appropriate action under Foreigners Act.

New Delhi: Election Commission of India on Tuesday told Supreme Court that the exclusion of an individual from the electoral roll on account of absence of document, "does not ipso facto" result in deportation of the person.

The counsel for the poll body argued that ECI is legally empowered to refer such a case to the central government for scrutiny and take appropriate action under Foreigners Act.

The submission was made during the resumed hearing of a clutch of petitions challenging the constitutional validity of the special intensive revision of electoral rolls being carried out by the poll body in different states.


At the last hearing, ECI had submitted that not only does it have the constitutional competence to revise electoral rolls but it is also constitutionally duty-bound to ensure that there are no foreigners in the electoral rolls.
