'Danger to human life': Mumbai businessman fined Rs 5,000 for feeding pigeons in public

In a first-of-its-kind case, a Mumbai businessman has been convicted for feeding pigeons in a public place. A metropolitan magistrate court in Bandra found a 52-year-old Dadar-based businessman guilty, holding that the act posed a risk to public health and violated government directives.

The conviction marks the first such ruling since the Bombay High Court imposed a ban on feeding pigeons in public areas in July.

Additional Chief Judicial Magistrate V U Misal of the 9th court, Bandra, on December 22 convicted Dadar resident Nitin Sheth under Sections 223(b) and 271 of the Bharatiya Nyaya Sanhita (BNS), 2023. These provisions relate to disobedience of a lawful order issued by a public servant and acts likely to spread infection of diseases dangerous to life. The court imposed fines of Rs 3,000 and Rs 2,000 under the two sections.


Police had registered a criminal case against Sheth on August 1 for feeding pigeons near the kabutarkhana on L J Road, close to Hinduja Hospital. According to the police, the act endangered human life, health and safety and was likely to contribute to the spread of disease.

In its order, the magistrate observed, “Your act has caused danger to human life, health or safety and violated the orders of the government and thereby an offence punishable.” The court further stated that the accused had unlawfully or negligently committed an act which he knew, or had reason to believe, was likely to spread infection of a disease dangerous to life.

The case was registered at Mahim police station, and a chargesheet was filed within a month. During the proceedings, Sheth pleaded guilty to the charges, stating in his application that the plea was voluntary and requesting leniency. Accepting the plea, the court noted that considering the nature of the offence, a monetary penalty would be sufficient and imposed the fine accordingly.

Feeding pigeons in public places in Mumbai has been banned and declared illegal due to public health concerns. In July, the High Court directed authorities to take action against feeding birds in public areas. The issue has led to sharp differences, with public health advocates supporting the ban, while bird lovers and certain communities view feeding pigeons as a duty, resulting in political friction.
