The Lucknow Bench of the Allahabad High Court on Thursday made it clear that banks cannot freeze accounts merely on a police request without following the proper legal procedure. The bench warned that such action could lead to both civil and criminal consequences for the bank, a TOI report stated.

A division bench of Justices Shekhar B. Saraf and Manjeev Shukla passed the observation while hearing a petition by a medical store chain. The petitioner said his Axis Bank account was frozen after the Rachakonda police in Hyderabad issued a notice claiming that money had been fraudulently transferred to the petitioner’s account from the account of a cybercrime victim.

Bank admits receiving freeze notice but lacks formal order

During the hearing, the bank’s lawyer admitted that a debit freeze notice was received in November 2025. However, “no formal seizure order or specific information regarding the amount to be frozen has yet been provided.”


The court noted that the notice did not specify any amount and that despite repeated requests by the bank, “neither a copy of the FIR nor a formal seizure order was provided to the bank.” The judges concluded that, on these grounds, the account cannot remain frozen.

Account to be immediately de-frozen

The High Court ordered the immediate de-freezing of the account. It also issued clear guidelines for banks and investigating officers. Information regarding the freezing of any bank account should be sent immediately to the nodal officer of the bank or payment service system to allow timely action.

The court further directed that “a copy of any notice regarding account blocking should also be sent to the judicial magistrate of the jurisdiction for information.”

The ruling is likely to affect how banks respond to police requests across the country, ensuring account holders are not unfairly blocked without proper legal procedures.
