Assam’s Nagaon district orders expulsion of 15 declared foreigners; BJP MLA’s citizenship challenged in HC

The order to expel them has been issued under intensifying action under the Immigrants (Expulsion from Assam) Act, 1950. According to official documents issued by the Office of the District Commissioner Nagaon, the individuals were declared foreigners after failing to establish Indian citizenship before the concerned tribunals.
The individuals are residents of various villages under several police stations, including Raha, Kaliabor, Samaguri and Rupahi. According to the Nagaon District Deputy Commissioner’s office, all these cases were initiated on the basis of letter No.?NGN/B/2025/1442 (datedNovember17, 2025) sent by the Senior Superintendent of Police, Nagaon.
The orders direct that each of them must leave Indian territory within 24 hours of receiving the notice, failing which the authorities are empowered to initiate forcible removal from Assam and India. The expulsion orders, passed under Section 2 of the Immigrants Act, authorise district police, border authorities and administrative officials to execute the removals. The orders also instruct officials to delete the names of the declared foreigners from electoral rolls, cancel Aadhaar cards and ensure that no government benefits are extended to them.
Writ petition questioning citizenship of MLA
A writ petition filed before the Gauhati High Court questioning the citizenship status of Ratabari (Schedule Caste ) MLA Bijoy Malakar. The petition sought his disqualification from the Assam Legislative Assembly on the ground that he is allegedly “not an Indian citizen”. Malakar is BJP MLA.
The petition, moved by Braja Gopal Sinha and Bijoy Kumar Kanu stated that Malakar and his parents entered Assam after the cut-off date of March 25, 1971, making him ineligible to hold public office under the Constitution and the Representation of the People Act, 1951.
The petition states that Malakar’s name first appeared in the electoral roll only in the supplementary voters’ list of 2005, at Serial No. 318 of Part No. 96 under Karimganj North Assembly constituency, “without any basis”. It further claims that his father’s name did not appear in voters’ lists prior to 2005, including the crucial 1966 and 1971 rolls.
The respondents in the case include the State of Assam, the Speaker of the Assam Legislative Assembly, the district administration, border police authorities, the Chief Electoral Officer of Assam and the Election Commission of India.
