Assam govt tables bill to exempt CM’s political aides from office of profit rules
Guwahati: Assam government tabled a legislation Assam State Legislature Members (Removal of Disqualifications) Act, 1950 following which the office of the Political Secretary to the Chief Minister, Assam and the office of the Political Advisor to the Chief Minister will not come under the ambit of office of profit criteria.

The bill tabled on Monday stated,” Article 191(1)(a) of the Constitution of India provides that a person shall be disqualified for being chosen as, and for being, a Member of the Legislative Assembly if he holds any office of profit under the Government, other than an office declared by law not to disqualify its holder. The Government of Assam considered it necessary in public interest to declare the office of the Political Secretary to the Chief Minister, Assam and the office of the Political Advisor to the Chief Minister, Assam as offices which shall not disqualify their holders for being chosen as, or for being, Members of the Assam Legislative Assembly. “

Earlier there was an ordinance to keep the two posts out of the office of profit. The proposed legislation stated, “As the Assam Legislative Assembly was not in session and circumstances existed which rendered it necessary to take immediate action, the Governor of Assam promulgated the Assam State Legislature Members (Removal of Disqualifications) (Amendment) Ordinance, 2026 (Assam Ordinance No. II of 2026) on the 9th June, 2026. It is now proposed to replace the said Ordinance by an Act of the State Legislature".


The legislation added with a view to immediately declaring the offices of the Political Secretary to the Chief Minister, Assam and the Political Advisor to the Chief Minister, Assam as offices that shall not disqualify their holders from being chosen as, or for being, Members of the Assam Legislative Assembly, the Government promulgated the Assam State Legislature Members (Removal of Disqualifications) (Amendment) Ordinance, 2026 (Ordinance No. II of 2026), as the Assam Legislative Assembly was not in session. The proposed provision of the Assam State Legislature Members (Removal of Disqualifications) (Amendment) Bill, 2026 by replacing the Assam State Legislature Members (Removal of Disqualifications) (Amendment) Ordinance, 2026.
