Android Case: SC to hear CCI, Google appeals on Oct 10

Google has challenged the National Company Appellate Tribunal's (NCLAT) March 29 order that upheld the ₹1,337-crore fine imposed on it by the CCI for misusing its dominant position in the Android ecosystem.

The Supreme Court on Friday posted the cross-appeals filed by Google and the Competition Commission of India (CCI) in an antitrust case for final hearing on October 10. It asked all the parties to submit brief submissions and exchange them in advance with other advocates in the matter before October 3.

Google has challenged the National Company Appellate Tribunal's (NCLAT) March 29 order that upheld the ₹1,337-crore fine imposed on it by the CCI for misusing its dominant position in the Android ecosystem. The CCI has appealed part of the NCLAT order that held that for proving abuse of dominance under Section 4 of the Competition Act, the watchdog needed to carry out an "effect analysis" on whether the abusive conduct was anticompetitive or not

HDFC vs IL&FS


The SC dismissed HDFC Ltd's appeal against an NCLAT order allowing the sale of the IL&FS headquarters in Mumbai to Canadian investor Brookfield. The NCLAT had turned down HDFC's plea for a stay on the sale of the property located at a prime location in the Bandra Kurla Complex. Lenders had approved Brookfield Private Capital entity Project Holding Seven's ₹1,080 crore bid for the property by a 73.5% vote.
