Special prosecution officer Madhav Sharma said the minor girl was alone at her home when the paternal uncle sexually assaulted her.
The girl's mother informed about the rape to her husband and mother-in-law once she found out about the assault. However, instead of approaching the police, they locked the survivor and her mother in a room and beat them up to silence them.
The survivor's mother managed to reach the police station after 40 days of the incident and filed a complaint, following which a case was registered under IPC sections 376 (rape), 323 (voluntarily causing hurt), 504 (intentional insult), 506 (criminal intimidation), 342 (wrongful confinement) and the Protection of Children from Sexual Offences (Pocso) Act.
After gathering all evidence, witnesses and the survivor's statement, special judge Shiv Kumar found the girl's uncle guilty of rape, and sentenced him to 20 years in prison and imposed a fine of Rs 50,000 on the convict.
The girl's father and grandmother were also booked but their cases were separated after they approached the high court and appealed against charging them under Pocso Act. The trial in their other case is on in the same court, said Sharma.
