TDSAT's hearing on default calls on Feb 19

new delhi: the stay on telecom regulator's directive on sharing of default traffic on mobile to mobile std calls between bharti and bharat sanchar would continue, while telecom dispute settlement and appellate tribunal on friday scheduled the next hearing of the case for february 19. bharti had filed their reply to the interim application of bsnl in which the stay was granted. but as that application is no more pending so bharti's reply would now be on the main petition, sources said. following this, bsnl would file its rejoinder by february 18, and the next hearing would take place on february 19, they added. bharti's much hyped foray into std operations suffered a set-back on january 31 when tdsat stayed trai's order for distribution of default traffic between bharti and bsnl on alternate days. the stay came after bsnl moved the tribunal the previous day against trai's order dated january 25, 2002 stating that revenue accruing from default calls, where costomers do not specify choice of their call carriers (here in reference to state owned bsnl or private operators like bharti), would be shared equally between exisiting operators. bsnl, in the last hearing had said that trai had no powers to decide as to who would get business (in terms of std traffic) and on what basis. during the course of the stay, all default std calls on mobile phones would be routed through bsnl as against the earlier arrangement where it was to be distributed equally between bharti and bsnl. bsnl had recently asked the department of telecommunications to restrain launch of std operations by first private operator bharti, saying lack of preparedness on access code could lead to collapse of domestic long-distance network. bsnl had earlier also argued that bharti has not fulfilled conditions including mutual agreement with the service providers before launching its operations. bsnl chairman and managing director d p s seth, in a recent communication to dot secretary shyamal ghosh, had warned that launch of operations without proper preparedness including installation of software and hardware for giving options to consumers to dial the carrier access code, could lead to collapse of the entire std network.
