a working group on labour laws has recommended a seven-pronged action plan, including prohibition of outsiders from assuming trade union leadership for special economic zones, export processing zones and export-oriented units. in its report. the working group on labour laws and other labour regulations for the tenth plan has suggested exemption of eou/epzs from the provisions of the contract labour act and setting up of exclusive special industrial tribunals for sezs to settle disputes. the trade union act could be amended to prohibit outsiders from assuming leadership of trade unions in these units and flexibility should be given to units to dismiss employees who go on illegal strikes, it said. other suggestions include delegating powers of the labour commissioner to the development commissioner of epzs, declaration of eous and epz units as 'public utility services' under the industrial disputes act and setting up of exclusive special industrial tribunals for sezs and epzs to give top priority to settle the disputes. in order to reduce harrasment on account of frequent inspections, it has suggested introduction of the system of self-certification for industrial units in small scale and information technology sector, where reports submitted are self-certified and treated as prima-facie compliance. stating that administrative regime in respect of furnishing reports and inspections had led to disproportionate regulatory burden being placed in the ssi units, the group said the concept of self-certification needs to be adopted by all the states and union territories. the it industry should be kept free from inspection related harassments and that these should be resorted only when they are absolutely necessary, it said. as labour laws are in the concurrent list, it would be appropriate to permit each state government to make amendments to the labour laws as per their requirements, the group said. it further stated that special quasi-judicial tribunals manned by the department officers of the labour departments could take up the hearing of the dispute in the first instance once the conciliatory talks fail. suggesting rehabilitation and re-employment of people losing their jobs in areas like trade and tourism, the working group said that since employment generation is a serious concern labour laws should not come in the way of employment generation. there is an urgent need for evolving a scheme to pull a part of the vrs ex-gratia recieved by such restructured employees to enable them to get regular monthly remuneration, it said adding that health, safety and welfare of workers should be given due importance while reviewing labour laws. people going out of job need to be rehabilitated and employed in some vocations namely trade and tourism, it added.
