Planning Commission for enactment of Right to Marital Property Act

The government today said a panel set up by the Planning Commission has recommended enactment of 'Right to Marital Property Act'.

NEW DELHI: The government today said a panel set up by the Planning Commission has recommended enactment of 'Right to Marital Property Act', which would treat all assets of a couple as joint property and can be divided in case of separation.

The working group on Women's agency and empowerment for the 12th Plan constituted by the Planning Commission under the chairpersonship of Ministry of Women and Child Development Secretary has made such a recommendation, Law and Justice minister Salman Khurshid told Lok Sabha in reply to a query.

The panel recommended enactment of a comprehensive Right to Marital Property Act, applicable to all communities, which should treat all movable and immovable assets of a married couple or a couple living together as joint property and which can be divided at the time of separation/desertion, regardless of who has bought the property, the minister said.
