Department of company affairs (DCA) has removed yet another layer of discretion — this time in case of delay in notifying RoC about managerial appointments.

NEW DELHI: Department of company affairs (DCA) has removed yet another layer of discretion — this time in case of delay in notifying RoC about managerial appointments.
DCA has issued a circular empowering the registrar of companies (RoC) to charge companies that fail to disclose appointments of managing directors and whole-time directors within the stipulated 90 days.
The late fee ranges from one time the normal fee to nine times normal filing fee.
DCA release said RoC will charge additional fees as form 25C on managerial appointments is a document required to be filed with RoC, and any delay in filing it with RoC will be treated, under Section 611, on par with failure to file other documents required to be filed with RoC.
