The rule mandates the selection committee to make at least two recommendations for each vacancy based on the overall assessment of eligible candidates including personal interaction after taking into account the record of past performance and integrity.
The member and president shall be paid a salary of Rs 2.25 lakh per month and in case they are in receipt of any pension, the pension amount will be deducted from the salary.
The President and member shall be entitled to draw allowances and benefits as are admissible to a Government of India officer holding Group 'A' post carrying the same pay.
However they will not get the benefits of provident fund and gratuity.
“President or the Member shall, before entering upon his office, declare his assets, and his liabilities and financial and other interests,” the notification said.
Where, the person appointed as President or Member is a serving judge of the Supreme Court or a High Court or a serving Member of an organised Service, he shall either resign or obtain voluntary retirement before joining the Tribunal.
It also specifies that the President, or Member of the tribunal shall not undertake any arbitration assignment while functioning in these capacities in the Tribunal.
“President, or Member of the Tribunal, shall not, for a period of two years from the date on which they cease to hold office, accept any employment in, or connected with the management or administration of, any person who has been a party to a proceeding before the Tribunal,” the notification added.
While making its assessment for suitability to a post, the Committee shall give additional weightage to persons seeking re-appointment on the basis of their experience in the Tribunal.
In case the committee receives any complaint against the member, the inquiry has to be initiated which should be completed within six months.
Government on September 15 notified 31 benches of GST Appellate Tribunal.
