Assocham for major changes in Indian Patent Act

Associated Chamber of Commerce and Industry on Friday demanded that the definition of invention as required under Article 27 in Indian Patent Act be expanded to include food, medicine and drugs.

NEW DELHI: Associated Chamber of Commerce and Industry on Friday demanded that the definition of ‘invention’ as required under Article 27 in Indian Patent Act be expanded to include food, medicine and drugs.
Since definition of invention will now read as ''invention means a new product or process in all fields of technology involving an inventive step and capable of industrial application'', Assocham said "it may be better to also include sections relating to independent definitions of food, medicine and drugs."
As there is no distinction between chemical and other substances used in drugs, the chamber said Section 5(2) would be redundant and could be deleted.
The chamber also suggested inclusion of mathematical or business methods or computer programs within the ambit of patentable subject matter.
