High Court restrains Delhi company from using Infosys trademark

Delhi High Court restrains Southern Infosys, a software firm, from using 'Infosys' in a manner that infringes the trademark rights of Infosys, giving four months for transition to a non-infringing name.

In a major relief to the country's second largest information technology firm Infosys, the Delhi High Court has restrained Southern Infosys from using 'Infosys' as part of its trade or corporate name or in any other manner that infringed the former's trademark till the final disposal of the case.

The court has given Delhi-based software firm Southern Infosys four months to make the transition to a non-infringing name. Justice Sanjeev Narula, in his order, said that on a "prima facie assessment," Southern Infosys' use of the mark 'Infosys' not only infringes upon the IT major's trademark rights, but also risks causing confusion among consumers and diluting the trademark's commercial value.
