Lalit and Samir Modi
Godfrey Phillips director Bina Modi on Monday withdrew her contempt petition filed against her sons - Lalit and Samir Modi – in the Supreme Court.

Her counsel told a Bench led by Justice Sanjeev Khanna that she is not “pressing the contempt” against her estranged son Samir's allegations that she assaulted him when he was trying to join the board meeting of the company.

Bina wanted the apex court to initiate contempt proceedings against Lalit and Samir for their wilful disobedience of the order of the SC’s August 1, 2022 order that asked parties to refrain from making any disparaging statements on social media during mediation.

Since mediation between former IPL chairman Lalit Modi and his mother Bina to resolve their pending family dispute over a trust property named after Lalit’s father KK Modi under SC appointed mediator former judge R.V. Raveendran has failed, so no contempt would lie.

Bina in her contempt plea had alleged that her sons “have (and continue to) repeatedly publish contemptuous posts on social media and give contemptuous interviews to news outlets containing patent falsities in respect of the dispute that is sub judice.

The most recent act of violation of the SC’s order is the result of the alleged contemnors giving false and concocted information/interview to media wherein Samir had “concocted a patently false story about a premeditated attack” by Bina Modi and the members of the board of Godfrey Philips India (GPI) against Samir who had alleged that the attack was “orchestrated because of greed and to deprive me of my rights, my inheritance and with the intention to kill me,” the plea stated.

Refuting any such claims, Bina said that there was no attack whatsoever on Samir. “The electronic evidence of the CCTV footage and the personal affidavits of several eye-witnesses will establish that there is not an iota of truth in the story sought to be put out by the alleged contemnors. The alleged contemnors have put forth a concocted and manufactured a contemptuous, defamatory and knowingly false story and narrative around the events that transpired at scheduled board meeting of GPI on May 30 with the ill objective of interfering with the judicial process,” the contempt petition had stated.
