SC grants interim protection from arrest to Ekta Kapoor over objectionable content in web series 'XXX'

Earlier this year, a PIL was filed before the Allahabad High Court seeking a blanket ban on the series.

The FIR cited offences under Sections 294, 298 and 34 of the IPC, Sections 67 and 67-A of IT Act and Section 3 of State Emblem Act.
The Supreme Court, on Thursday, granted interim protection from arrest to TV Czarina Ekta Kapoor in relation to an FIR registered against her for alleged objectionable content in the second season of the web series 'XXX'.

The Bench headed by Chief Justice SA Bobde was hearing a petition filed by Kapoor against the order passed by Madhya Pradesh High Court which refused to quash the FIR against her.

According to the wesbite Bar and Bench, Bobde, while granting interim relief to Kapoor remarked, "We don't like the Madhya Pradesh High Court order".


In his November 11 order, Justice Shailendra Shukla of the Madhya Pradesh High Court opined that applying the test of obscenity from the point of view of an ordinary person, there was some substance in the State's stance that the XXX episode could cater to the prurient interest of a normal major person.

The High Court added that "it is through leading of evidence only, that the test of obscenity would be affirmed", while declining to quash the FIR against Kapoor.

The FIR was filed against Kapoor, being the Managing Director of ALT Balaji which airs the show, alleging that Episode 1 of Season 2 in the show “XXX” was obscene, hurtful of religious sentiments and disrespectful of the National Emblem.

The FIR cited offences under Sections 294, 298 and 34 of the IPC, Sections 67 and 67-A of IT Act and Section 3 of State Emblem Act. The Emblem Act and Section 298, IPC charges were, however, quashed by the High Court in its November order.

Earlier this year, a PIL was filed before the Allahabad High Court seeking a blanket ban on streaming of "XXX - Season 2", allegedly for disrespecting the Indian Army and their uniforms. The plea was however dismissed with a direction to approach the competent authority first.

After the Cambridge Analytica scandal, Zuckerberg found himself in hot water again, but this time, it was not because of the breach of user data or privacy concerns.It was over political ads.

The political ads on Facebook had always been the centre of conversation and there had been much conjecture over their accuracy (or lack thereof). In 2019, in a speech at Georgetown University in mid-October, Facebook CEO Mark Zuckerberg said, ‘We don’t fact-check political ads’.
