The release of Jana Nayagan, widely promoted as Thalapathy Vijay’s final film before his full-time political entry, continues to face uncertainty after a fresh development in the Madras High Court. The legal dispute surrounding the film’s censor certification has once again drawn attention, raising questions about when audiences will finally get to watch the much-awaited project.

According to a report by Live Law today (January 27), a division bench of the Madras High Court has set aside an earlier order that directed the Central Board of Film Certification (CBFC) to grant a U/A certificate to the film. The bench, led by Chief Justice Manindra Mohan Shrivastava and Justice G Arul Murugan, has sent the matter back to a single judge for fresh consideration.

The court observed that the earlier proceedings did not fully follow principles of natural justice, as the censor board was not given sufficient opportunity to present its side.



The division bench has now instructed the single judge to hear the case again after allowing the CBFC to file its response. The producers, KVN Productions, have also been given the freedom to amend their writ petition if needed. Importantly, the court’s latest order does not amount to a ban on the film, nor does it reject its certification outright. Instead, it resets the legal process, keeping the issue of censor clearance open.

For the unversed, the controversy began when the CBFC delayed issuing a certificate to Jana Nayagan despite the film going through the usual screening process. According to the makers, the examining committee had recommended a U/A certificate after suggesting certain cuts, which they claim were implemented in full. However, the certification process stalled when the film was later referred to a revising committee, which led the producers to approach the court as the release date was affected.

The CBFC, on its part, told the court that the referral to the revising committee was based on a complaint from a member of the examining committee. The complaint reportedly raised concerns about scenes that could hurt religious sentiments and the portrayal of the armed forces. The board maintained that these objections required further examination, justifying the additional review.

Earlier this month, a single judge of the Madras High Court had ruled in favour of the production house and directed the CBFC to issue the certificate without further delay. The judge had observed that the board appeared to have exceeded its authority by ordering a review after indicating that certification would be granted. H

owever, that order was swiftly stayed by a division bench, which also made strong remarks against the producers for creating what it described as “artificial urgency” by announcing a release date without obtaining censor clearance.

During the hearings, senior advocates representing KVN Productions argued that the board’s actions were inconsistent and unfair. They stated that objections cited in the complaint had already been addressed and that revisiting those scenes served no real purpose. The CBFC, represented by the Additional Solicitor General, countered that it was not given enough time to file a detailed reply and that certain procedural aspects had not been challenged by the producers.

What does this mean for Jana Nayagan’s release?

As of now, the film does not have a final censor certificate. While the certification process is still ongoing, the release date remains uncertain and will depend on how quickly the single judge re-hears and decides the matter. For now, fans may have to wait a little longer to see Vijay’s much-talked-about final outing on the big screen.
