Oscar-winning actress Halle Berry faced allegations from her former husband, Oliver Martinez over an incident involving their 12 year old son, Maceo. Martinez filed for a temporary restraining order on October 1, according to court documents reported by PEOPLE and Page Six.

He alleged that Berry physically attacked Maceo during an argument on September 26. According to Martinez’s filing, Berry jumped on their son, put her hands around his neck and choked him.

According to his claim, the argument began while Maeco was using virtual reality goggles at Berry’s home. He alleged that Berry became angry with the boy and insulted him before the situation escalated. Martinez also claimed that Maceo called him during the incident.

He said he heard their son panicking while Berry was still shouting in the background. Martinez alleged that he then went to Berry’s home and took Maceo with him.He also claimed that it was not the first such incident.

According to the filing, Martinez alleged that there had been other incidents in which Berry had physically, verbally or emotionally abused their son. These are allegations made in Martinez’s court filing.

What has Halle Berry said?

Berry strongly denied the allegations through her lawyer, Marina Beck. According to a report by TMZ, she called his ex-husband’s filling “meritless and deliberately misleading” in a statement. She also alleged that Martinez had repeatedly violated court orders and interfered with therapeutic and educational arrangements for their son.

Berry’s lawyer said those actions had previously resulted in legal sanctions against Martinez. The lawyer also referred to Martinez’s alleged history of violent and erratic behavior. Berry has therefore disputed Martinez’s account of what happened and said she remains focused on Maceo’s wellbeing.

What was the court’s decision?

A Los Angeles County judge granted Martinez a temporary restraining order on October 1.

The judge ordered Berry to stay 100 yards away from Martinez. However, she has not been completely prevented from seeing Maceo. According to TMZ, Berry can continue seeing her son through court-ordered visitation. The arrangement allows visits two days a week and every other weekend until a hearing on October 16.

The court also ordered Berry and Martinez to take part in confidential mediation over their custody dispute, according to TMZ.
