Zoom Developers’ petition against Vizhinjam project dismissed

Kerala High Court has dismissed a writ petition filed by Zoom Developers against the state government and Vizhinjam International Seaport.

Kerala High Court has dismissed a writ petition filed by Mumbai-based Zoom Developers against the state government and Vizhinjam International Seaport for disqualifying its proposal for construction of the Vizhinjam Deepwater Seaport and International Transhipment Container Terminal.


While dismissing the petition, Justice Thottathil B Radhakrishnan said that the decision arrived at by the government and the company thorough the high Level bid evaluation committee was not vitiated.

Zoom in its petition has contented that of the five consortia that had submitted tenders for the project, three were pre-qualified. They were Lanco Consortium, Videocon Consortium and Nagarjuna Consortium. Zoom Consortium and Apollo Consortium were disqualified.

The Zoom proposal was disqualified on the main ground that they had changed the consortium partners after the final date of submission of the agreement and that they had not stated that they would be jointly and severely liable for execution of the project.

The work for the construction was finally awarded to the Hyderabad-based Lanco Kondapalli Power.

The Mumbai-based company had gone to the court against Kerala government challenging the bidding process which disqualified their consortium from bidding for international container transshipment terminal at Vizhinjam.

Earlier also Zoom had issues with the project. One may recall that Vizhinjam port project was thrown to retendering because central cabinet committee on security had vetoed clearance to the two Chinese partners in a consortium-led by Zoom.
