Suspense over Sunil Mittal case hearing continues

The suspense over whether Bharti Telecom CEO Sunil Mittal's fate continued, with another supreme court judge recusing himself from hearing his plea.

NEW DELHI: The suspense over whether Bharti Telecom CEO Sunil Mittal's fate continued, with another supreme court judge recusing himself from hearing his plea against summoning and the CJI deferring hearing of the case for now.


Earlier justice Vikramjit Sen had recused himself from the case. Today justice Anil R Dave recused himself from the case.

The CJI then said that he would take a call on who would hear the case and directed that the trial court proceedings be deferred by a week till the top court decides Mittal's plea.

The CBI again opposed the CJI's attempt to hear the case saying that it should be heard by the 2G bench, headed by justice G S Singhvi.

But the CJI did not indicate whether it would be placed before that bench.

Mittal has challenged the 2G special court decision to summon him as an accused despite the CBI decision not to name him as an accused in the chargesheet.

The CBI had only named three companies including Bharti and Essar, but the special judge summoned the MDs Mittal and Ravi Ruia as well.

Ruia has also challenged the summoning. But their pleas have not been heard by the top court so far.
