Govt should not allocate GSM spectrum till HC decision: COAI

COAI has challenged TDSAT's decision of not staying the spectrum allocation process in High Court and the case would come up for hearing on January 3.

NEW DELHI: Cellular Operators Association of India, the lobby of GSM mobile players on Wednesday asked the government not to allot spectrum to CDMA operators or any new player before a decision of the Delhi High Court on the issue.

COAI has challenged TDSAT's decision of not staying the spectrum allocation process in High Court and the case would come up for hearing on January 3.

"In view of the magnitude and seriousness of the matter, the issues involved and the pendency of proceedings before the High Court, it is earnestly requested that Department of Telecom do await the decision of the Court and not proceed with GSM spectrum to CDMA operators," COAI said.

It said in a statement the government should not issue any license or spectrum to new applicants who have applied after December 2006 till the matter is pending in the court.

Going forward with the allocation process would be an act of impropriety and amount to over-reaching and preempting a court decision, COAI said.
