New Delhi: Homebuyers of 16 stalled housing projects by bankrupt builder Supertech are planning to approach the Supreme Court again for proper implementation of it’s order as there is no progress on construction after state-run NBCC taking over the work almost two years ago.

Homebuyers said NBCC is waiting for exemption from Real Estate Regulatory Authority (RERA) before starting the work as RERA registration will restrict the use of fund from one project to another.

“I had booked the flat in 2011 and like me there are thousand of homebuyers who were hopeful after the NBCC takeover. But after seeing no constructive work happening, we are forced to approach the court again. Flats would have been at the delivery stage had the work started two years ago, when NBCC takeover was announced. Amicus Curiae, who was to oversee implementation of SC orders, should come forward and explain the delay,” said Susheel Bhati, president of Upcountry welfare association.

These 16 projects comprise 50,962 homes, of which 39,870 were sold. Of the homes that were sold, 24,871 were already handed over to buyers, while 14,999 are yet to be delivered.

Completion of work on the sold apartments requires an investment of Rs 1,700 crore. Receivables from these units are estimated to be Rs 2,200 crore.

“Buyers are suffering because of the system. SC order was a positive one but it has to be implemented on ground. The members appointed needed to urgently implement it as for buyers every day is crucial,” said Mujeebur Rahman, a homebuyer.

As per the latest the National Company Law Tribunal (NCLT) order, NBCC has in discussion with the ACC (apex court committee) proposed that construction including structural and necessary repair works shall commence from 16 January 2027.

NBCC will continue the due diligence and audit required for commencement of construction.

“We all want NBCC to begin the work and homebuyers are cornered with the delay. But we don’t have any other option but to wait,” said Aakash Goel, coordinator of 26,500 United Homebuyers at Supertech Ltd.

NCLT order has highlighted challenges in some projects where available information is not matching with the position on ground.

For example, Czar Suites (which is one of the 16 NBCC Projects), while the approval granted by the concerned land authority was for construction of only 844 units, the actual construction on ground as on date comprises 1,908 units, which is in clear violation of the applicable statutory and regulatory approvals.

In Upcountry, sixteen towers have been constructed, of which 5 have been handed over and 11 partially handed over. The towers are approximately 23-27 floors high, i.e. about 75-90 metres.

However, the sanctioned and RERA-approved plan presently available with NBCC reflect approval only up to 30 metres.

NBCC is presently finalising the tender documents for the 16 projects. NBCC presently proposes to issue 27 and more separate sub-tender packages in respect of these projects through transparent open e-tendering process.

NBCC has in discussion with ACC submitted that the Tender Packages will be issued in phases between 1 October 2026 and 15 October 2026, with all 27 and more Tender Packages proposed to be floated by 15 October 2026.

NBCC has further submitted to the ACC that the Tender Packages may require a minimum period of 60 days from the date of publication of the NIT to accommodate the requisite publicity period, evaluation, and scrutiny.
