SC notice to UP on hotel site cancellation issue
The Supreme Court on Wednesday issued a notice to the Uttar Pradesh government on a batch of petitions related to the cancellation of allotment of land to 14 hotels in Noida which were to be built for the 2010 Commonwealth Games.
NEW DELHI: The Supreme Court on Wednesday issued a notice to the Uttar Pradesh government on a batch of petitions related to the cancellation of allotment of land to 14 hotels in Noida which were to be built for the 2010 Commonwealth Games.
A bench headed by Chief Justice K G Balakrishnan issued a notice to the state government and the Noida authority after senior counsel Harish Salve, appearing for ITC, mentioned the matter. It also directed the parties to maintain staus quo till July 18, the next date of hearing.
Salve argued that the Mayawati government had scrapped the allotments made by the Mulayam Singh government citing corruption in land auctions.
Various hospitality companies including ITC, Royal Orchid, Clarkston Hotels and others have challenged a Allahabad High Court judgement in which it quashed the cancellation orders passed by Noida authorities and had remanded the matter to the state government for reconsideration.
According to the petitioners, it would be futile to go back to the state government to present their case as "the hearing in such a case would be illusory."
The interpretation of the High court was erroneous, the petitioners said. ITC said that grant of land to hotels at industrial rates was an incentive for setting up the hotels in the state.
