SC to decide on NIIT plea in November
The Supreme Court will decide in November NIIT Ltd's petition against award of a contract to Teledata Informatics Ltd for imparting IT education in schools in Bihar.
A bench headed by Justice Arijit Pasayat has posted the matter for final hearing in the second week of November. Earlier, it had issued notice to the Bihar government, Bihar State Electronics Development Corporation and its Managing Director Alok V Chaturvedi and Teledata.
NIIT has sought quashing of the Patna High Court's judgement, which upheld the award of contract for setting up computer labs in 1,000 schools for a period of three years on lease maintenance and transfer basis to Teledata.
According to the petitioner, the High court erred in upholding the award of contract after having conclusively held that Teledata had not fulfilled the eligibility criteria.
The criteria for a bidder was the experience of having executed a similar work in 200 schools in a single state and the same should not have been relaxed, the petition filed through Pradeep Bakshi said, adding that this would result in substandard education to students.
Besides, Teledata was guilty of perjury for having taken a contrary stand on oath before the High Court and its bid was non-responsive as it had deliberately quoted price for only 13 out of 25 components.
"All other important components like costs of course ware, annual maintenance contract and other hardware accessories, maintenance of infrastructure, etc were deliberately missed out in the bid of the respondent," the company submitted.
NIIT further claimed that it had developed a unique and innovative teaching technology K-12 for providing the world class IT skills to school students.
