MUMBAI: Ramona D���Souza, a partner of PN Writer & Co, has moved the Bombay High Court alleging that her brothers Willaim and Denzil D���Souza, also partners of the firm, had fraudulently transferred the assets of the company to a private firm, Writer Corporation. William (deceased) and Denzil had formed Writer Corporation in which Ramona is not a partner.

She has asked for an injunction so that her brothers could not transfer their rights in Writer Corporation to a third party. The High Court has denied her an interim relief. Justice Anand Nirgude has observed that ���the case of the plaintiff (Ramona) that she was unaware of these transfers is rather difficult to believe.���

Justice Nirgude held that a previous Bombay High Court order restrained the company from disposing of and transferring the assets or destroying any accounts. This should eliminate Ramona���s fear that her brothers would transfer their rights to a third party, the court observed adding there was no need for any further interim relief in the matter.

Earlier, Ramona had moved the court alleging that her brothers were siphoning off funds from the company, which is engaged in removing, clearing, forwarding, shipping, packing and storage businesses. The court had then restrained PN Writer & Co from transferring its assets or destroying any accounts and records. The court had also directed Denzil to pay Ramona a sum of Rs 50,000 per month.

When Denzil had challenged the order in the Supreme Court, the apex court had confirmed the high court order and had appointed retired Justice SP Bharucha as the arbitrator to settle the dispute. The arbitration proceedings are pending.
