An MRTPC bench comprising chairman O P Dwivedi and member D C Gupta gave about 10 days to file the affidavit and posted the matter for hearing on October 23 after Tendulkar’s counsel Bina Madhvan sought some more time. Nike’s counsel Dushyant Dave told the court, “Sachin Tendulkar was told to file affidavit on last hearing but he has not filed it yet. No court can expect to wait for a party to file affidavit for a long time.”
During the last hearing in September, the commission had directed the cricket star to file an affidavit before it. Nike had earlier refused to give an undertaking before the Commission that it would not use the name and image of Sachin Tendulkar till its case with rival Adidas over endorsement rights of the cricket star is pending.
