Disposing of a petition filed by Kuttan Theri Tharisu Membattu Vivasayigal Sangam seeking to quash a MoU signed between the company and Tamil Nadu government for acquisition of 12,000 acres of land for mining, a division bench comprising Justices Elipe Dharmarao and M Venugopal said statutory authorities should take into consideration the representations made by petitioners while taking Environment Impact Assessment. The petitioners should also be given opportunity to represent their grievances personally, the court said.
Tamil Nadu Pollution Control Board (TNPCB) in its counter submitted that TISCO could implement the project only after getting environment clearance from Union Ministry of Environment and Forest and "consent for establishment" from the Board.
The Judges said that statutory authorities - the Union Ministry and TNPCB - were already seized of the matter, hence the petition was premature. "There is no doubt without complying with statutory obligations TISCO cannot proceed with the establishment of the project".
