UK court rejects Ranbaxy's appeal against drug patent

In a setback to country's biggest drug maker Ranbaxy Laboratories, the UK Court of Appeal has upheld an earlier ruling by the UK High Court of Justice, rejecting its appeal against Pfizer's patent for cholesterol lowering drug Lipitor.


NEW DELHI: In a setback to country's biggest drug maker Ranbaxy Laboratories, the UK Court of Appeal has upheld an earlier ruling by the UK High Court of Justice, rejecting its appeal against Pfizer's patent for cholesterol lowering drug Lipitor.

The company said it was evaluating this decision and will decide on its course of action shortly in a statement here.

The three-judge panel ruled that the Ranbaxy's atorvastatin product infringed the broadest claims of (Pfizer) Warner-Lambert's European Patent 247 633 in the UK.

The panel, however, confirmed that (Pfizer) Warner-Lambert's European Patent 409 281 was invalid in the UK.

The ruling meant that Ranbaxy will have to wait till 2011 to market the generic version of Lipitor in the UK market.

Pfizer's cholesterol-lowering drug Lipitor had generated close to $12.2 billion in revenue last year. Ranbaxy has been locked in patent battle with Pfizer over Lipitor patent in the US and other countries across Europe.
