NEW DELHI: Pharma major Morepen Laboratories' plans to set up a facility in Haryana for development of herbal products has run into rough weather as the Supreme Court has refused to stay dispossession of land earmarked for the purpose.

A bench headed by Justice H K Sema dismissed the company's petition as withdrawn and asked it to approach the concerned high court.

Morepen counsel Abhishek Singhvi and Prabhjit Jauhar desired to withdraw the petition with a view to approach the High Court for a review application, the court said, adding "the special leave petition is dismissed on withdrawal".

The company had moved the apex court seeking release of its land purchased in 1989 in Begumpur Khatola village, Gurgaon, for setting up the laboratory.

A large portion of its land for development of an integerated complex for industrial and recreational purposes was acquired by the Haryana government for public purposes.

The Punjab and Haryana High Court had also upheld the decision of the high-powered committee that recommended acquisition on the ground that there was only one roofless unutilised shed at the spot.

According to Morepen, the High Court's findings that the land was vacant was baseless as the land was being used for cultivating herbs required for carrying out research and development, which is essential for any pharma company.

The acquisition of land would be detrimental to the interests of Morepen and would jeopardise the whole plan on which it had spent more Rs 10 crores in R&D, the company's petition stated.
