Sanofi, Abbott file lawsuit against Glenmark

Sanofi-Aventis SA and Abbott Laboratories have jointly filed a lawsuit against Glenmark to prevent the Indian company from selling its hypertension drug in the US.

France’s largest drug maker Sanofi-Aventis SA and Abbott Laboratories have jointly filed a lawsuit against Glenmark to prevent the Indian company from selling a generic version of its hypertension drug Tarka in the US. Glenmark had filed on July, 24th an application with the US FDA to market a copy of the medicine in the US.

The two drug majors are seeking a court order blocking Glenmark from selling the drug in the US until the patent expires in 2015. Sanofi granted Abbott in 2004 an exclusive licence to market the combination of the compounds trandolapril and verapamil hydrochloride in the US.

“Glenmark Pharma is first to file for this product is therefore eligible for 180-days exclusivity in the US generic market if we get a court ruling in our favour,” said Mr Saldanha. According to the Indian company, Tarka has annual sales of $100-120 million (at innovator’s price) in the US alone.
