HC allows Anil Nanda to make Fortis party in EHRIC case

The Delhi High Court allowed Anil Nanda's plea to include Fortis Healthcare as a party in the ongoing suit against his elder brother Rajan Nanda over sale of Escorts Heart Institute and Research Centre (EHRIC).

NEW DELHI: The Delhi High Court today allowed Anil Nanda's plea to include Fortis Healthcare as a party in the ongoing suit against his elder brother Rajan Nanda over sale of Escorts Heart Institute and Research Centre (EHRIC).

Anil is involved in a legal battle with Rajan over sale of EHRIC to Fortis Healthcare Ltd for Rs 5.65 billion.

A single member bench of Justice Manmohan Singh today allowed Anil's amendment application to include Fortis Healthcare, promoted by Malvinder Singh family, as a respondent in the ongoing proceedings before it.

In its application Anil has submitted that in 2005, when he filed suit against his elder brother Rajan over amalgamation of EHRIC Delhi and EHRIC Chandigarh, then deal of its sale to Fortis Healthcare was not complete, so he could not make the hospital chain a party in the case.

He has also requested the court to quash the deal between Rajan and Fortis over change of management of EHRIC.

Anil was represented by his counsel P K Bansal and senior advocate Sandeep Sethi.

Earlier on Jauary 16, a division bench of the Delhi High Court had restrained Rajan from converting charitable trust of Escort Hospital into a private company.

The court has listed the matter on October 15 for the next hearing.
