Delhi HC bench asks single judge to explain curbs on PepsiCo

The company approached the HC against the Food Safety and Standards Authority of India's (FSSAI) order asking manufacturers of high-caffeine beverages to stop using the "energy drink" descriptor on their products, terming it a misleading claim.

NEW DELHI: A division bench of the Delhi High Court sought detailed reasons for the interim order from a judge who restricted PepsiCo India Holdings from using the "energy drink" trade descriptor on fresh batches of its Adrenaline Rush and Sting Energy brands.

The division bench on Monday asked the single-judge bench of the same court to provide reasons within a week to enable it to deal with PepsiCo's appeal.

The company approached the HC against the Food Safety and Standards Authority of India's (FSSAI) order asking manufacturers of high-caffeine beverages to stop using the "energy drink" descriptor on their products, terming it a misleading claim.

Challenging Justice Amit Mahajan's decision before the division bench, PepsiCo sought parity with Red Bull India's case where the company argued that the same judge quashed the FSSAI's order.
