NCLT Mumbai's outsourcing staff goes on strike over delay in salary

More than 150 outsourcing and contractual staff at the Mumbai bench of the National Company Law Tribunal (NCLT) went on strike Tuesday over non-payment of December salary.

In a memorandum to the registrar of NCLT Mumbai, the striking workers said they were “refraining from performing their professional obligations” till all their grievances were addressed.

They are demanding immediate release of their December 2024 salary and also a revision of the same, saying salaries have not been revised since the inception of the NCLT on June 1, 2016.


“We have not received our salary for the month of December 2024,” the striking workers said in the memorandum. “Every time we approach your good office, we get a reply that we have not received the funds from MCA (ministry of corporate affairs) on time for releasing the salaries due to which we all are facing hardships.”

The striking staff said they have been facing delays in salary disbursements for the last six months.

Of the 156 staff members on strike, 86 are contractual and about 70 outsourcing staff.

The Mumbai bench of the NCLT has six courts.

The NCLT is a quasi-judicial body that is part of the MCA. It deals with corporate disputes such as oppression and mismanagement and scheme matters such as mergers and amalgamation under the Companies Act. It also adjudicates cases under the Insolvency & Bankruptcy Code (IBC).

Ashish Pyasi, partner at law firm Aendri Legal, said the issue needs to be resolved at the earliest since it affects the working of the bench and cases pending before it.

“The MCA must take immediate steps to resolve the issue,” Pyasi said, adding the litigants suffer the most due to strikes.

A total of 8,002 companies across sectors were brought into administration until September end, according to the latest data from IBBI. Of these, 1,963 are still undergoing the corporate insolvency resolution process.
