New Delhi: The Delhi High Court on Tuesday issued notice on a plea filed by ED, seeking to expunge certain "adverse, sweeping and unwarranted observations" against it by a CBI court while discharging all the 23 accused in the Delhi excise policy case. The discharged included former Delhi CM Arvind Kejriwal, former deputy CM Manish Sisodia and others.

Taking up ED's plea, Justice Swarana Kanta Sharma verbally remarked: "It has nothing to do with the case in question... I am going through this. I do need to call for a reply. ED's counsel argued that the special CBI judge has passed adverse and damaging remarks against the federal agency. "There are direct allegations against ED in a matter in which ED is not a party, ED is not concerned... The judge has no business to make such observations," the counsel argued.


Justice Sharma said: "Whatever the judge has said was not in respect to this case. These are general observations that some judges, including me, make." The counsel said the CBI judge could have called upon ED and heard its side before passing such remarks.
