Nirbhaya rape: Former SC Justice K Joseph backs life imprisonment over execution

Retired justice of Supreme Court, Kurian Joseph advocated the idea of sending the 2012 gang rape case convicts behind the bards instead of execution. He said, "By hanging these people (Nirbhaya case convicts), will such type of crimes stop? In Bachan Singh case, SC said that death penalty can be handed over in rarest of rare case and only when all other options are unquestionably foreclosed." He further added, "If people who commit such crimes are sent to jail forever, society can be told that if anyone indulges in such sort of crimes, they will be behind bars forever whereas people forget (about the crime) after the execution." A Delhi court on March 18 has issued notice to Tihar Jail and prosecution (State) on convicts’ plea seeking stay on their death sentence on the grounds of pendency of various legal applications, appeals and second mercy pleas. Court to take up the matter tomorrow.
